Terms of Service
Rules of service, responsibilities of the parties, and limitations of liability for Permanent Sleep Press Commercial Printing & Publishing.
1. Scope of Services
Permanent Sleep Press provides commercial printing and publishing services, including but not limited to book production, brochure printing, and custom print layouts. All services are performed at our facility in County Offaly, Ireland, unless otherwise agreed in writing.
We reserve the right to refuse any order that does not meet our quality standards or legal requirements. Clients must provide accurate and complete materials for pre-press setup. Any delays caused by incomplete or incorrect client materials may affect delivery timelines.
2. Client Responsibilities
Clients are responsible for ensuring that all content submitted for printing does not infringe on any third-party copyrights, trademarks, or other intellectual property rights. By submitting materials, you confirm that you hold the necessary permissions or licenses for all content.
Clients must review and approve all proofs before production begins. Permanent Sleep Press is not liable for errors in the final printed product that were present in the approved proof. Changes requested after approval may incur additional charges and delay delivery.
3. Pricing and Payment
All prices are quoted in euros (EUR) and are valid for 30 days from the date of the quote, unless otherwise stated. Quotes are based on the specifications provided at the time of request. Any changes to specifications may result in a revised quote.
Payment terms are net 30 days for approved corporate accounts. For all other clients, full payment is required before production begins. Late payments may incur a fee of 1.5% per month on the outstanding balance.
4. Delivery and Shipping
Estimated delivery dates are provided in good faith but are not guaranteed. Permanent Sleep Press is not liable for delays caused by shipping carriers, customs, or other factors beyond our control.
Risk of loss or damage passes to the client upon delivery to the carrier. Claims for damaged or missing items must be submitted within 7 days of receipt. We will assist in filing claims with the carrier but are not responsible for reimbursement.
5. Returns and Refunds
Due to the custom nature of our services, all sales are final. Refunds or reprints are issued only in cases of manufacturing defects or errors attributable to Permanent Sleep Press. Claims must be made within 14 days of delivery.
We will reprint or refund at our discretion. No refunds will be issued for errors in client-provided materials or for changes requested after production has begun.
6. Intellectual Property
All original designs, layouts, and pre-press files created by Permanent Sleep Press remain our intellectual property unless otherwise agreed in writing. Clients retain ownership of their content and receive a license to use the final printed materials for their intended purpose.
We reserve the right to display completed projects in our portfolio and marketing materials unless the client requests confidentiality in writing.
7. Limitation of Liability
Permanent Sleep Press's total liability for any claim arising from our services is limited to the amount paid by the client for the specific order giving rise to the claim. We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, business interruption, or damage to reputation.
This limitation applies regardless of the form of action, whether in contract, tort, or otherwise. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply in full.
8. Termination
Either party may terminate a project agreement with 14 days written notice. In the event of termination, the client is responsible for payment for all work completed up to the date of termination, including materials and pre-press setup.
Permanent Sleep Press may terminate any agreement immediately if the client breaches these terms or engages in conduct that damages our reputation or operations.
9. Changes to Terms
We may update these terms from time to time. Changes will be posted on this page and take effect 30 days after posting. Continued use of our services after that date constitutes acceptance of the updated terms.
